Internet crimes and punishments

Increasingly, in the news feeds we see reports of various crimes committed with the help of the Internet or directly in it. The more a global network enters our life, the more people appear in it with the intent to violate the rights of a particular user, invading the sphere of his personal network resources. For some individuals, the activity of deliberately violating the rights of others becomes a kind of hobby on the Internet or even a way of life. Internet frauds are becoming increasingly popular among criminals. Meanwhile, we should not forget that sooner or later you will have to pay for any crime. Virtual private property is protected by the state almost on a par with physical, and any attempt to encroach on it must be punished by the laws provided for separately in each of the states that seek to develop information technologies at the world level.
At the mention of crimes committed in the field of computer and Internet technologies, the 28th chapter of the Criminal Code of Russia immediately comes to mind, which regulates the punishment for offenses committed. Article 272 of the Criminal Code, referred to as “Illegal access to computer information”, deals with cases when a page was hacked on social networks, a postal address was opened, or passwords were illegally changed. This article indicates that for all these atrocities a fine is levied, ranging from 200 to 500 minimum wages or other wages for a period of 2 to 5 months. And correctional work can be provided for a period of six months to a year or the convicted person can be deprived of liberty for up to 2 years. By the way, the second part of the same article 272 for the same violations, but already committed by several persons, is punished with a fine of 500 to 800 minimum wages or other wages, for a period of 5 to 8 months. Or in the form of correctional labor for a period of 1 to 2 years. In addition, imprisonment for up to 5 years or simply arrest for 3-6 months is provided for. Punished and those who read the information hidden from the general view. In Ukraine, the punishment for such Internet crimes is even more severe than in Russia. The size of fines and terms of conviction is significantly higher.
However, if we take and consider the system of punishments for atrocities in the virtual space of the Internet, we can see how this system is still little worked out. According to experts of Russia, the majority of Internet fraudsters should be convicted under other articles in the Criminal Code, and not only using chapter 28. Of course, the fault in these circumstances is difficult to prove, but the punishment will follow a very harsh one.
It became popular to stir obscene expressions and provocative pictures on the victim’s page. And this is the 213 article of the Criminal Code. An attacker falling under it is punished with community service for 120-180 hours, arrest for 4-6 months, or imprisonment for 2 years or a little less. And with a group crime, respectively, and the punishment will be more severe.
There is another common hooliganism. On the main page are placed various insults. In this case, if the attacker is caught, he will be presented with article 129 of the Criminal Code of Russia. The penalty in this case will be from 50 to 100 minimum wages or other wages. The duration of compulsory work will be 120-180 hours, and correctional work – up to 1 year.
But the most urgent problem that worries many citizens is the enmity of religions. Muslim hackers broke into many sites of European newspapers and placed various signatures, on the first pages of which they scolded Christianity and called to fight the infidels. And this is already 282 article of the Criminal Code of Russia. Here the penalty is 500-800 minimum wages, or the restriction of freedom for up to 3 years, and you can lose from 2 to 4 years. This punishment should be when trying to stir up national hostility and racial aggression by Internet criminals. In addition, in these cases, the 354 article is entitled, entitled: “Public appeals for the outbreak of an aggressive war.” And in this case, the fine threatens with a size of 500-700 minimum wages or other income, as well as imprisonment for up to 3 years.
This is not the whole list of punishments for crimes in the Internet environment. The Criminal Code has in its possession and such articles that suit attackers who place the state symbols on any third-party site. And Article 329 of the Criminal Code of Russia is responsible for this and provides for such punishment as restriction of liberty for about 2 years, arrest for 3-6 months, or imprisonment for up to one year.
In order for society to develop freely with the help of information technologies in its own country, the state simply needs to constantly improve the legal framework in the field of all kinds of crimes in the Internet space.
